Cannabis Regulation in Spain: What You Should Know
There is no single rule as simple as “cannabis is legal in Spain”. Private settings, public space, Cannabis Social Clubs, driving and medical use involve different legal contexts.

Spain does not have a general system authorising recreational cannabis retail to the public. Criminal law, administrative rules and case law set different limits depending on the conduct and circumstances.

01 · GENERAL POSITION
Is cannabis legal in Spain?
There is no general legalisation of recreational cannabis. Article 368 of the Spanish Criminal Code criminalises, among other conduct, cultivation, production, trafficking and acts that promote, encourage or facilitate illegal drug consumption, as well as possession for those purposes.
Mere consumption is not the conduct described in that article, but this does not mean every form of consumption or possession is permitted: administrative offences and other rules also apply.

02 · PRIVATE SETTINGS
The distinction starts with private settings
Article 368 of the Spanish Criminal Code does not make mere cannabis consumption a criminal offence. That does not create a general authorisation to buy, sell, cultivate or distribute cannabis.
The legal position depends on the specific conduct and circumstances. That is why it is important to distinguish consumption in a private setting from what happens in public spaces or from activities that may involve supply or distribution.
03 · PUBLIC SPACE
Public space has different rules
Organic Law 4/2015 treats unlawful consumption or possession of drugs in public places, roads, public establishments and collective transport as a serious administrative offence, even when the substances are not intended for trafficking.

The same law also addresses unlawful planting and cultivation of drugs visible to the public where the conduct does not constitute a criminal offence.
04 · CANNABIS SOCIAL CLUBS
Where do Cannabis Social Clubs fit?
A Cannabis Social Club is a private association, not a cannabis shop open to the public.
Each club sets its own access and admission conditions. Being interested in visiting, requesting a first visit or attending an appointment does not automatically make you a member.

Having a confirmed first visit does not mean a person is already a member.
Important
Operating as an association does not mean that every cannabis-related activity is automatically permitted. For that reason, The Crew does not present any club as “legal” or legally certify its activity.
05 · VISITORS
What a visitor should know
If you are visiting Spain, do not assume you can simply walk into a Cannabis Social Club.
Each club has its own requirements. Before travelling there, check the stated minimum age, required identification, available languages and whether it accepts requests from visitors.

06 · DRIVING
Cannabis and driving
Do not drive after using cannabis. Spain’s Traffic Law treats driving with drugs present in the body as a very serious administrative offence where the conduct is not a criminal offence.

07 · MEDICAL CANNABIS
What about medical cannabis?
Medical cannabis follows a separate framework from recreational use. Royal Decree 903/2025 regulates standardised compounded preparations made from standardised cannabis preparations.
Prescription is limited to hospital specialists in the circumstances set out by the regulation, and preparation and dispensing take place through hospital pharmacy services. In 2026, AEMPS published registration information and the corresponding National Formulary material.

This medical framework does not turn Cannabis Social Clubs into medical cannabis establishments.
